Specialty Practice
Litigation Support and Expert Witness Real Estate Appraisers

Independent, well-supported commercial real estate valuation for attorneys and their clients, from early case assessment through testimony.

Independent Valuation Expertise

An Expert Witness Who Speaks the Language of Litigation

When real property is at the center of a dispute, value is often the question that decides the outcome. Courts, arbitrators, and attorneys will test every assumption behind that number. They may also challenge the credentials of the appraiser witness. Valbridge Property Advisors provides litigation support by providing written appraisals and hourly consulting.

Our MAI-designated appraisers bring both expertise and courtroom experience to matters ranging from construction defects, title claims, marital dissolution, partnership disputes, and eminent domain.

As a national commercial appraisal firm with local market knowledge in every office, we can support your case wherever the property is located. As an independent commercial appraiser, we advocate for our analysis, never for a party. That independence is what gives our opinions their weight.

Litigation Support Appraisal Services

Real estate disputes take many forms. Our appraisal services for attorneys span the full range of matters in which property value, damages, or ownership interests are in question.

If a property is harmed, the measure of damages often depends on the difference between its value before and after the event. We quantify diminution in value arising from construction defects, environmental contamination, nuisance, trespass, inverse condemnation and loss of use. We also analyze market stigma, cost-to-cure, and casualty losses from wildfire, flood, and other disasters.
A title defect, encroachment, or disputed easement can impair marketability and value. We support title insurance claims, quiet title actions, and boundary disputes by measuring the effect of the defect on the property and valuing easements and the burden they place on the servient estate.
Commercial and investment real estate is frequently among the most significant assets in a marital estate. Our divorce real property appraisal services provide credible values as of the date of separation, the date of trial, or another date the court requires. We also support the apportionment of community and separate property interests when both contributed to an asset.
Disputes among owners call for valuation that addresses both the real estate and the interest being valued. We provide business and partnership valuation support for dissolution of partnership, shareholder and LLC member disputes, buyouts, and buy-sell agreement valuations. Our fractional interest valuation and partial interest appraisal work applies well-supported discounts for lack of control and marketability. We also provide partition action appraisal services when co-owners cannot agree on the disposition of a property.

Beneficiary and trustee disputes often turn on what a property was worth at a specific moment. We prepare retrospective date of death appraisals, review values reported in prior filings, and support counsel in matters before probate courts and in IRS challenges, including cases before the U.S. Tax Court. Our eminent domain appraisal and condemnation appraisal services address full and partial takings, severance damages, special benefits, and inverse condemnation claims. We work with both public agencies and property owners, and we screen every engagement for conflicts. Learn more about our Right-of-Way practice.

We provide valuation support for Chapter 11 plan confirmation and cramdown proceedings, relief from stay motions, foreclosure and deficiency judgment actions, and lender liability claims. Our appraisal review services also help counsel evaluate the credibility of a prior appraisal in malpractice and negligence claims.
When parties disagree about rent or contract performance, we provide market rent determinations, ground lease rent resets, and damages analysis for breach of lease, lost rent, and failed purchase agreements. We regularly serve as an appraiser in lease arbitration proceedings.
An overassessment can cost a property owner significantly year after year. Our property tax appeal appraisal services give owners and their counsel well-supported market value opinions for assessment appeals board hearings and related proceedings.
